Welcome to Agilepitch! These Terms of Service ("Terms") are a legal agreement between you (the "User") and Agilepitch Limited ("Agilepitch," "we," "our," or "us") regarding your use of the Agilepitch platform and related services. By accessing or using our services, you agree to be bound by these Terms.

Introduction

Agilepitch Limited, located at The Old Rectory, Dunganstown, Wicklow, A67 YE19, Ireland, provides a sales intelligence and automation platform ("Agilepitch") that enables sales teams to build custom workflows and automation through natural language. The Agilepitch AI Engine, Michael, helps users gain deep insights into sales signals.

Eligibility

To use Agilepitch, you must be at least 16 years old. There are no restrictions on user categories, but by using the platform, you represent that you meet this age requirement and have the capacity to enter into this agreement.

Account Creation and Security

Users are required to create an account to access our services. Registration occurs when you attempt to log in for the first time. Single Sign-On (SSO) is available upon request. Users must maintain the confidentiality of their credentials and comply with password requirements. You may also choose to enable two-factor authentication (2FA) or SSO for enhanced security.

Subscription and Payment

Subscription Plans: Agilepitch offers a 1-week free trial upon initial subscription. After that, pricing starts at €15 per month for individual licenses. Team licenses are available upon request, with bulk discounts available.

Modifications and Cancellations: Users may cancel or modify their subscription through the Agilepitch settings page or by contacting us at james@agilepitch.io.

Pricing Changes: Pricing is subject to change, and users will be notified in advance of any adjustments.

Data Retention and Privacy

Data Requests: Users may request a copy of their data by emailing dataprotection@agilepitch.io.

Subprocessors: Agilepitch uses OpenAI and Cohere as subprocessors. If additional subprocessors are introduced, users will be notified in writing.

Opt-Out: Users can opt out of data collection for specific purposes by emailing dataprotection@agilepitch.io.

Data Backup and Recovery: Agilepitch has a data backup and recovery policy, which is available in the privacy policy.

Acceptable Use Policy

Prohibited Activities: Users may not scrape content from the platform, attempt to reverse-engineer Agilepitch, or upload offensive, incriminating, or harmful data intended to cause harm. Any accounts engaging in these activities will be terminated.

Fair Use: Users must comply with our Fair Use Policy to ensure equitable access for all users. API call limits and storage limits apply based on subscription tiers.

User Termination and Suspension

Users may terminate their account via the Agilepitch settings page.

Agilepitch may suspend or terminate accounts if users fail to pay subscription fees, upload offensive data, attempt reverse engineering, or misuse the platform for spamming purposes.

Intellectual Property

Users own the content and data they create or upload using Agilepitch. Agilepitch retains ownership of the technology that powers the platform. Users may download and share any content generated by the platform.

Third-Party Integrations

Agilepitch integrates with various third-party tools, including CRMs, communication platforms, databases, and mail servers. Users integrate these services at their own discretion, and there are no warranties or disclaimers provided regarding the use of these integrations.

Modifications to the Terms

Agilepitch reserves the right to modify these Terms. Users will be notified of any changes via email and the Agilepitch app at least two weeks prior to the changes taking effect.

Dispute Resolution

Mediation and Arbitration: In the event of disputes, we prefer disputes to be settled through mediation first. If mediation is unsuccessful, disputes may proceed to arbitration in Ireland, England, or Wales. The United States of America is excluded from arbitration.

Governing Law

These Terms are governed by the laws of Ireland.

Force Majeure

Agilepitch shall not be held liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to natural disasters, wars, strikes, or interruptions in internet services.

User Feedback

Agilepitch collects feedback in the form of ratings and surveys to improve the platform. We do not collect user data through third-party integrations or uploads.

Limitation of Liability

The limitation of liability for disputes and damages will be determined through mediation. Agilepitch is not responsible for any data held by third-party services integrated into the platform.
