Welcome to Agilepitch! These Terms of Service ("Terms") are a legal agreement between you (the "User") and Agilepitch Limited ("Agilepitch," "we," "our," or "us") regarding your use of the Agilepitch platform and related services. By accessing or using our services, you agree to be bound by these Terms.

Introduction

Agilepitch Limited, located at The Old Rectory, Dunganstown, Wicklow, A67 YE19, Ireland, provides a sales intelligence and automation platform ("Agilepitch") that enables sales teams to build custom workflows and automation through natural language. The Agilepitch AI Engine, Michael, helps users gain deep insights into sales signals.

Eligibility

To use Agilepitch, you must be at least 16 years old. By using the platform, you confirm that you meet this age requirement and have the capacity to enter into this agreement.

Account Creation and Security

Users are required to create an account to access our services. Registration occurs when you log in for the first time. Single Sign-On (SSO) is available upon request. Users must maintain the confidentiality of their credentials. Two-factor authentication (2FA) is also available.

Subscription and Payment

• Subscription Plans: 1-week free trial, then €15/month per individual license. Team licenses and bulk discounts available upon request.
• Modifications and Cancellations: Can be managed via settings or by emailing james@agilepitch.io.
• Pricing Changes: We notify users in advance of any price changes.

Data Retention and Privacy

• Request data by emailing dataprotection@agilepitch.io.
• We use OpenAI and Cohere as subprocessors; any changes will be communicated.
• Users can opt out of data collection via email.
• We follow a strict backup and recovery policy outlined in our Privacy Policy.

Acceptable Use Policy

• No scraping, reverse engineering, or uploading offensive or harmful data.
• Violators may be terminated without notice.
• Fair use applies with API and storage limits based on your plan.

User Termination and Suspension

Users can terminate their accounts through the settings page. Agilepitch may suspend or terminate accounts for non-payment, policy violations, or misuse of services.

Intellectual Property

Users retain ownership of their uploaded or created content. Agilepitch retains ownership of the platform and technology. Users can download or share generated content.

Third-Party Integrations

Agilepitch integrates with various CRMs, mail servers, and databases. Use of these is at the user’s discretion, and we do not provide warranties on third-party integrations.

Modifications to the Terms

We may modify these Terms with 2 weeks' prior notice via email or in-app alerts.

Dispute Resolution

We prefer to settle disputes through mediation. If mediation fails, arbitration may follow in Ireland, England, or Wales. The U.S. is excluded from arbitration options.

Governing Law

These Terms are governed by the laws of Ireland.

Force Majeure

We are not liable for delays or failures due to causes beyond our control such as natural disasters, wars, strikes, or internet failures.

User Feedback

We collect feedback via ratings and surveys to improve the platform. No user data is collected through third-party integrations or uploads.

Limitation of Liability

Liabilities for disputes and damages will be determined through mediation. We are not liable for any third-party data use or loss.
